Arbitration as a means of resolving disputes between Clients & Lawyers in Zimbabwe
Arbitration is an alternative means to litigation for resolving disputes between parties. In general, most of the Letters of Engagement which are also known as Mandate Agreements in Zimbabwe contain an arbitration clause, in respect of which disputes between a client and a law firm or a client and a lawyer are resolved.
More often than not procurement agreements for legal services in Zimbabwe using Framework Agreements and subsequently Call-Off Contracts provide for the resolution of disputes between procuring entities such as client and lawyers in Zimbabwe by means of arbitration. see Chinhoyi Municipality v Mangwana & Partners & Another 2016 (1) ZLR 42 (H).
