Arbitration of Disputes Concerning Procurement Services for Legal Services in Zimbabwe
The procurement of legal services by procuring entities in Zimbabwe is generally done using Framework Agreements and subsequently Call-Off Contracts. Generally, all Framework Agreement General Provisions or Framework Agreement Specific Provisions (“FA Specific Provisions”) provide for the resolution of procurement services by means of arbitration. Similarly, Call-Off Contracts have Special Conditions of Call-Off Contract (SCC) which provide for arbitration of disputes by means of arbitration. It is therefore not uncommon for disputes between law firms concerning procurement services for legal services in Zimbabwe to be resolved through arbitration. One case which illustrates the fact that disputes concerning procurement services for legal services in Zimbabwe are resolved by means of arbitration is Chinhoyi Municipality v Mangwana & Partners & Another 2016 (1) ZLR 42 (H).
