Assessment of Damages for Unlawful Dismissal in Zimbabwe

In Zimbabwe an employee is entitled to be awarded damages which are equal to the wages or salary that he or she would have earned save for the premature termination of his or her employment contract. Furthermore, an employee in Zimbabwe may be compensated for the loss of any benefit to which he or she was contractually entitled and of which he or she was deprived as a consequence of the breach. see Gauntlet Security Services v Leonard 1997 (1) ZLR 583 (S).

The concept of damages for unlawful dismissal in Zimbabwe aims to place an employee in the position he or she would have been had their employment contract run its full course, unless, the contract of employment specifies otherwise with a specific termination clause. see University of Zimbabwe v Zhakata N.O. & Another SC 34-24. In assessing damages for unlawful dismissal in Zimbabwe, an employee is entitled to be awarded the amount of wages or salary he or she would have earned save for the unlawful dismissal by the employer. see Zimbabwe Revenue Authority v Mudzimuwaona 2018 (1) ZLR 159 (S).
