Can a School in Zimbabwe Be Sued?
Yes. A school in Zimbabwe can be sued. Whether the school is a mixed school, single sex school, government or non – government school, schools in Zimbabwe are recognised as corporate bodies which are capable of suing and being sued.
The case of Phida & Another v East View High School 2015 (1) ZLR 991 (H) is an example of a case in terms of which a parent sued the school for damages for emotional and psychological trauma endured after the rape of her daughter and her exposure to drugs.
It is important to know the correct citation of a school. In most cases, claims are enforceable against the School Development Committee (‘SDC’) and not against the school. see Lusama Fashion Enterprises (Pvt) Ltd v Mt Selinda High School & Another 2019 (3) ZLR 855 (H).
