Concealing assets can be regarded as fraudulent behaviour and can take various forms and spouses may employ different strategies to cover their tracks. There needs to be openness and transparency in a marriage. However, the courts have noted that there is a limit to ‘openness, because there may be categories of assets which the disclosing spouse knows about and the other spouse does not, and which the disclosing spouse genuinely believes do not form part of his or her estate.
