Designated Agents Roles to Redress or Attempt to Redress Disputes in Zimbabwe

Section 63(3a) of the Labour Act [Chapter 28:01] in Zimbabwe outlines the role of a Designated Agent in Zimbabwe. In Zimbabwe, a Designated Agent has the mandate to redress or attempt to redress any dispute which would have been referred to him or her, or which dispute would have otherwise come to his or her attention where the dispute occurs in the undertaking or industry and within the area for which the National Employment Council for which the Designated Agent is registered belongs to. see Gutu Rural District Council v Mugayo SC 86-23 and Blue Ribbon Foods Ltd v Tsatsa & 10 Others SC 57-24. The Constitutional Court of Zimbabwe in Isoquant Investments (Pvt) Ltd v Darikwa 2020 (1) ZLR 1268 (CC) held that a Designated Agent could either redress or attempt to redress any dispute which is referred to him or her or has come to his or her attention. In Zimbabwe a Designated Agent cannot do both i.e., redress and attempt to redress. If a Designated Agent choose to attempt to redress a dispute, he or she cannot at the same time redress the dispute.
