Duties of Employment Councils in Zimbabwe

Upon registration of an Employment Council in Zimbabwe the Registrar of Labour issues a Certificate of Registration. Furthermore, the provisions of the CBA become binding on all persons who fall within the scope of the Employment Council to which it relates. see Econet Wireless (Pvt) Ltd v The Minister of Public Service Labour and Social Welfare & Another 2016 (1) ZLR 1066 (S) 1069.

In terms of section 62 of the Labour Act [Chapter 28:01] an Employment Council which has been set up in Zimbabwe, within an undertaking or industry and in the area in respect of which it is registered is required to: assist its members in the conclusion of the CBA.

An Employment Council in Zimbabwe is charged with the responsibility of preventing disputes arising within the undertaking or industry as well as settling all disputes which may arise within the industry or undertaking in respect of which the Employment Council was registered.

Furthermore, an Employment Council is specifically charged by section 62 of the Labour Act [Chapter 28:01] with the duty of resolving disputes: between employers or employers organisations on the one hand and employees, workers committees or trade unions on the other, and to take all steps it considers expedient to bring about the regulation or settlement of matters of mutual interest to such persons or bodies.
