Grounds for the eviction of a statutory tenant in Zimbabwe
In terms of section 22(2) of the Commercial Premises (Rent) Regulations 1983 no order for the recovery of possession of business, commercial or industrial premises or for the ejectment of a lessee from a commercial, industrial or business premises which has expired either by effluxion of time or in consequence of notice duly given by the landlord/lessor to the tenant/lessee can be made to the court as long as:
- The tenant/lessee continues to pay the rent due (within seven days of the due date);
- The tenant/lessee continues to perform the other conditions of the lessee, unless the court is satisfied that the landlord/lessor has good and sufficient grounds for requiring such other other than that the tenant/lessee has declined to agree to an increase in rent; or the lessor wishes to lease the premises to some other person.
