Landlord and tenant lease agreements in Zimbabwe

Most landlord and tenants enter into written or verbal lease agreements for the use and enjoyment of immovable property. Some of the typical names of these landlord and tenant lease agreements include, a notarial deed of lease, a memorandum of agreement of lease of immovable property etc. In simple, terms a lease agreement between a landlord and a tenant is a contract. It regulates the rights and duties of both the landlord and the tenant.

The fundamental terms of the land and tenant lease agreement are that in return for rental from the tenant the landlord undertakers that the tenant will have undisbursed use and enjoyment of the landlord’s property. In general, there are two types of tenancy agreements that is a tenancy agreement in respect of a residential property or a tenancy agreement in respect of a commercial property. With regard to a residential lease agreement, this is an agreement for the occupation of a building, or part of a building, including any rooms, flat, apartment, house or other immovable property which is designed as a dwelling for a single family which includes the usual appurtenances (grounds, parking space, outside rooms, workers quarters) and outbuildings and such services and other improvements.

A commercial lease agreement, is an agreement for any premises which are used for the carrying of any business, industry, trade or occupation and includes any ground, parking space, garage, outbuildings, workers quarters and other improvements in, on or let or used with such premises or part thereof.
