The Limitation of the Competition Act [Chapter 14:28]
The Competition Act [Chapter 14:28] (the Act) applies to all economic activities within or having an effect within Zimbabwe, but the Act is not to be construed so as to limit any rights acquired under the following:
- (a) The Plant Breeders Rights Act [Chapter 18:16]
- (b) The Copyright Act [Chapter 26:01]
- (c) The Industrial Designs Act [Chapter 26:02]
- (d) The Patents Act [Chapter 26:03]
- (e) The Trade Marks Act [Chapter 26:04]
It must be noted that the Competition Act [Chapter 14:28] does not apply to the above enactments, except to the extent that such rights are used for the purposes of enhancing or maintaining prices or any other consideration in a manner contemplated in the definition of restrictive practice in section 2 of the Competition Act [Chapter 14:28].
