Resolution of building and construction disputes in Zimbabwe
Most Zimbabwean building and construction contracts generally make provision for alternative dispute resolution (ADR). It is therefore not uncommon for construction and engineering disputes in Zimbabwe to be determined by ADR.
It is also not uncommon for construction contracts to contain arbitration clauses. Whether a construction contract makes reference to a Dispute Adjudication Board (DAB) or mediation, where a party to the contract is dissatisfied with the mediation, or failed to amicably resolve the dispute, such disputes are generally referred to arbitration.
It is not uncommon for certain disputes to be referred to such arbitral institutions as the Commercial Arbitration Centre (CAC) and the Alternative Dispute Solutions Centre (ADSC). It is not uncommon for professional organisations such as the Zimbabwe Institution of Engineers or the Valuers Council of Zimbabwe to determine construction disputes.
