Section 12(2) of the Zimbabwean Labour Act [Chapter 28:01]

Section 12(2) of the Labour Act [Chapter 28:01] requires every employer in Zimbabwe to furnish an employee, when employment commences, with written particulars of employment. Section 12(2) of the Labour Act [Chapter 28:01] covers a list of at least ten (1) itens which include the following:

• Hours of work 

• Particulars of any bonus or incentive production scheme;

• Particulars of any other benefits provided under the contract of employment.

• Particulars of the benefits receivable in the event of sickness or pregnancy 

• Particulars of the employee’s remuneration, its manner of calculation and the intervals at which it is paid;

• Particulars of vacation leave and vacation pay 

• The name and address of the employer;

• The period of time, if limited, for which the employee is engaged;

• The terms of any employment code;

• The terms of probation, if any;

It is submitted that section 12(2) of the Labour Act [Chapter 28:01] places a statutory duty of disclosure of written particulars of employment on an employer. Thus, where an employer in Zimbabwe fails, refuses or neglects to furnish an employee with written particulars on commencement of an employment relationship, an employee has a right to such information. 

In the event that the employer fails to furnish an employee with information set out in section 12(2) of the Labour Act [Chapter 28:01], an employee would be within their rights to book a legal consultation to discuss the issue with a legal practitioner of his or her choice.
