Selling Your Immovable Property in Zimbabwe Whilst in the Diaspora

• Can you sell your immovable property in Zimbabwe when you as the property owner are abroad?

Yes. It is possible for you to sell your immovable property in Zimbabwe whilst you as the property owner are abroad.

• How do you sell your immovable property in Zimbabwe whilst you as the property owner are abroad?

Answer. You can appoint an Estate Agent to sell the property on your behalf. You can do this by way of a notarised Special Power of Attorney (SPOA) in which you give the Estate Agent either a general or sole mandate to sell the property on your behalf. A sole mandate authorises the Estate Agent to sell the property to the exclusion of other Estate Agents whilst a general mandate allows you to appoint multiple Estate Agents to sell the property on your behalf.

• Who else do you need to appoint to facilitate the sale and transfer / conveyancing of the immovable property?

You need to appoint a Lawyer / Legal Practitioner who is a duly registered Conveyancer to peruse and advise you on the draft Sale Agreement to be prepared by the Estate Agent. This appointment does not require a Special Power of Attorney. You also need to appoint by way of a notarised Special Power of Attorney someone in Zimbabwe to be your agent for purposes of signing on your behalf the sale agreement and conveyancing documents as well as attending the interviews at the Zimbabwe Revenue Authority. The appointed Conveyancer is the one who attends to the transfer of the immovable property from the seller to the buyer.

• Who pays conveyancing fees?

In Zimbabwe conveyancing fees are paid by the buyer.

• How are the conveyancing fees calculated?

Conveyancing fees in Zimbabwe are calculated using the Law Society of Zimbabwe (Conveyancing Tariff) S.I. 104 of 2024.

• Can the purchase price be repatriated?

Yes. You can with Exchange Control approval from the Reserve Bank of Zimbabwe (RBZ) have the funds repatriated.
