Victoria Falls International Financial Centre as Amicus Curie in Arbitration Zimbabwe

The procedural concept of intervention in litigation, is well settled in Zimbabwe. The prerequisites for the intervention of a party in pending civil or criminal proceedings were set out in Rothmans of Pall Mall (Zimbabwe) v Jackson 1992 (2) ZLR 50 (H).

In terms of section 107 of the Banking (Victoria Falls International Financial Services Centre) (General) Regulations, 2026 the Victoria Falls International Financial Centre (“VFIFC”) may intervene as a party in any arbitration proceedings before the Victoria Falls International Arbitration Centre (“VFIAC”).

The VFIFC is an interested party in matters concerning the international financial services centre and can therefore intervene in arbitration proceedings, where it considers such intention appropriate to meet one or more of its regulatory objectives. see Whaley and Others (Law Society of Zimbabwe Intervening) v Cone Textiles (Pvt) Ltd 1989 (1) ZLR 54 (SC). Thus, where the VFIFC intervenes, it will, subject to any other law, have all the rights, duties and liabilities of such a party.
