Which laws apply to the resolution of church disputes in Zimbabwe?

There is no separate body of law in Zimbabwe that deals and regulates church disputes. In resolving church disputes in Zimbabwe, the courts have consistently applied the law of voluntary associations. Due to the fact that there is no homogenous law of voluntary associations in Zimbabwe, the law applicable to the resolution of church disputes in Zimbabwe has to be fashioned to meet the needs of the Zimbabwean churches.

It is common cause that religions associations, such as churches, have features which distinguish them from other associations or organisations. see Independent African Church v Maheya 1998 (1) ZLR 552 (H). Notwithstanding the absence of a separate body of law in Zimbabwe to be applied to the resolution of church disputes in Zimbabwe, where resolution of a church dispute involves matters of church doctrine and practices, the Zimbabwean courts apply the neutral principles of law. Furthermore, all questions involving churches in Zimbabwe may be resolved in terms of the express terms contained in church documents, such as constitutions, trust instruments, canons, etc. see Independent African Church v Maheya 2000 (1) ZLR 39 (H).
